1. Agreement to These Terms
These Terms of Service ("Terms") govern your use of the Claws-N-Scales website and any purchase you make from us. By creating an account, placing an order, or otherwise using this website, you agree to be bound by these Terms, our Shipping, Returns & Privacy policies, and any other policies referenced here. If you do not agree, please do not use this website or place an order.
2. Age Requirement
This website and its products are intended strictly for adults. By using this website you confirm that you are at least 18 years of age (or the age of majority in your province, state, or country of residence, whichever is higher). We may cancel any order or close any account we reasonably believe belongs to a person under that age.
3. Accounts
You are responsible for keeping your account login details confidential and for all activity that takes place under your account. Please provide accurate, current information — including your shipping address and email — so we can fulfil your order. We may suspend or terminate accounts used for fraud, abuse, or in violation of these Terms.
4. Products, Custom Orders & Handmade Variation
Our products are handcrafted. Made-to-order items are produced after you order, using the size, colour, and finish options you select. Because every piece is made by hand, small variations in colour, shading, shimmer, texture, and dimensions from the photos on this website are normal and are not considered defects. Colours may also appear differently depending on your screen. In-stock (ready-to-ship) pieces are finished items already made and are sold exactly as shown and described in their listing. Production times shown on the website are estimates, not guarantees.
5. Pricing & Payment
All prices are listed and charged in Canadian dollars (CAD). Prices, availability, and sales are subject to change without notice, but the price you pay is the one shown at checkout when your order is placed. Payment is due in full at the time of ordering and is processed securely by our payment provider — we never see or store your full card number. We reserve the right to refuse or cancel any order, including orders affected by a pricing or listing error, suspected fraud, or stock being unavailable. If we cancel an order you have paid for, you will receive a full refund. Any customs duties, import taxes, or brokerage fees charged by the destination country are the responsibility of the customer.
6. Shipping
Shipping is charged per item. Where possible, shipping is calculated at checkout from a live Canada Post rate based on each item's packed weight and dimensions and your destination. Where a live rate is not available, a flat shipping fee of $40.00 CAD per item applies. The shipping charge is shown before you pay. Orders ship in plain, discreet packaging. Delivery times are estimates provided by the carrier and are not guaranteed. Risk of loss passes to you once the carrier has delivered the parcel to the address you provided. We are not responsible for delays caused by the carrier or customs, or for parcels delivered to an incorrect address entered at checkout.
7. Returns & Refunds
All sales are final. No refunds or exchanges will be given unless the item is returned in its original packaging. To be eligible for a refund, all of the following must be true: • You email us at [email protected] within 14 days of delivery to request a return. • The item is unused, unwashed, undamaged, and in the same condition you received it. • The item is returned in its original packaging, including any inserts or wrapping it came with. Items returned without their original packaging, or that show any sign of use, will not be refunded and may be sent back to you at your expense. Because of the personal nature of these products, we cannot accept returns of used items for hygiene reasons. Return shipping costs are paid by the customer, and original shipping charges are non-refundable. We recommend using a tracked shipping service, as we are not responsible for returns lost in transit. Approved refunds are issued to the original payment method once we have received and inspected the returned item. Damaged, defective, or incorrect items: if your order arrives damaged, defective, or is not what you ordered, email us at [email protected] within 7 days of delivery with photos of the item and its packaging and we will repair, replace, or refund it at no cost to you. Nothing in this section limits any rights you may have under applicable consumer protection law that cannot be waived by contract.
8. Order Cancellations
In-stock pieces may be cancelled for a full refund if the order has not yet shipped. Made-to-order items may be cancelled for a full refund only if production has not yet started; once work on a custom piece has begun, the order cannot be cancelled.
9. Reviews & Content You Submit
If you submit a review, comment, or other content, you confirm it is your own honest opinion and does not contain anything unlawful, abusive, or infringing. You grant Claws-N-Scales a non-exclusive, royalty-free licence to display that content on this website. We may moderate, decline, or remove any submitted content at our discretion.
10. Intellectual Property
All designs, photos, text, logos, and other content on this website belong to Claws-N-Scales or its licensors and may not be copied, reproduced, or used commercially without our written permission. Purchasing a product does not transfer any rights to its design.
11. Acceptable Use
You agree not to misuse this website, including by attempting to gain unauthorized access, interfering with its operation, placing fraudulent orders, or using automated tools to scrape or copy its content.
12. Product Use & Limitation of Liability
Please inspect each product before use and follow any care and use instructions provided. Stop using any item that becomes damaged. Products are for adult personal use only. To the fullest extent permitted by law, Claws-N-Scales is not liable for any indirect, incidental, special, or consequential damages arising from your use of this website or our products, and our total liability for any claim relating to an order is limited to the amount you paid for that order. This website is provided "as is" without warranties of any kind, except those that cannot be excluded by law.
13. Privacy
Your personal information is handled as described in our Privacy Policy.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You agree that any dispute arising from these Terms or your purchase will be resolved in the courts of Ontario, except where the consumer protection laws of your place of residence give you the right to bring a claim elsewhere.
15. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the "last updated" date above will change. The version in effect at the time you place an order applies to that order.
